SKINNY DIPPING

Bloomberg reports that six native Americans have applied to the USPTO to have the WASHINGTON REDSKINS trade mark cancelled because it is

‘an extraordinarily insensitive and derogatory term and one that should not be granted exclusive trademark licenses by the federal government’

The term has already been the subject of one cancellation attempt that failed because the group applying for cancellation had been aware of the mark for many years, but had failed to take action. The new group of applicants are aged between 18 and 24 and can argue that they brought the challenge soon after becoming adults.

The IPKat thinks this all sounds a little rum. If a term is offensive, it is offensive, however old the applicants for invalidity are.
