NO SEX PLEASE, WE'RE EUROPEAN


The Register reports that the owner of a trade mark for sex.eu has failed in its attempt to secure the sex.eu domain name. Topeu has missed out to Yellow Register Online, which has trade marks for the term SEX, without the .eu suffix. EURid ruled that only the part before the suffix counts, and so the fact that Topeu’s trade mark exactly mirrored the disputed domain name did not count.

The IPKat says that this has got to be the right decision, and seconds the comments of panellist James Mitchell who said:
"Were this not the case then those companies who had gone out of their way (whether cynically or otherwise) to register a range of trademarks including '.eu' would effectively gain preference over all other trademark owners in their rights to .eu domains.”
