The mark is used for an alternative awards ceremony, where Breathe California of Sacramento-Emigrant Trails gives awards to films with the most and least incidences of smoking. This year the winner of the 'Thumbs Up' was 'What Happens in Vegas' and the 'Thumbs Down', 'The Curious Case of Benjamin Button'. 'Slumdog Millionaire' doesn't seem to have won any awards.

Hm, says the IPKat. He's not really sure that there would be confusion here. Tarnishment perhaps because of the association with cigarettes, but this would be a long shot, since the junior user is anti-smoking.
